Terms of Service

These Terms of Service ("Terms") govern your access to homewavemarketing.com (the "Site") and the services provided by Home Wave Marketing ("Home Wave Marketing," "HWM," "we," "us," or "our"). By using the Site or engaging our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Our Services
Home Wave Marketing provides marketing systems and services for home service and pressure washing businesses, which may include advertising management, funnels and landing pages, CRM setup, lead follow-up automation, websites, and related services. The specific scope, deliverables, and pricing of any engagement are set out in a separate proposal, order form, or agreement between you and HWM. If anything in those documents conflicts with these Terms, those documents control for that engagement.
2. Eligibility
You must be at least 18 years old and authorized to enter into agreements on behalf of your business to use our services.
3. Fees, Billing, and Renewal
Fees are described in your proposal or order form. Recurring services are billed in advance on a subscription basis and renew automatically for successive periods until cancelled in accordance with your agreement. If a payment is declined or past due, we may pause or suspend services until it is resolved. Advertising spend paid to third-party platforms is separate from our service fees unless stated otherwise.
4. Refunds and Cancellation
Unless your agreement states otherwise, fees are non-refundable once work for the applicable period has begun, and setup fees and amounts paid to advertising platforms are non-refundable. You may cancel recurring services as described in your agreement. Cancellation stops future billing but does not refund amounts already paid for the current period.
5. Your Responsibilities
- Provide accurate information and the materials, approvals, and access we need to perform the services in a timely manner.
- Maintain the rights to any content, logos, or materials you provide to us.
- Comply with the rules and policies of any third-party platforms used in your services.
6. Third-Party Platforms
Our services often rely on third-party platforms such as Meta, Google, hosting providers, and CRM tools. We are not responsible for their availability, actions, pricing, policy changes, or any suspension or loss of accounts those platforms may impose.
7. No Guarantee of Results
Marketing results depend on many factors outside our control, including your market, your offer, your pricing, your responsiveness, and third-party platforms. We work hard to deliver results, but we do not guarantee any specific number of leads, sales, revenue, rankings, or other outcomes.
8. Intellectual Property
The Site and its content, along with the systems, templates, processes, and know-how we use to deliver our services, are owned by Home Wave Marketing. Rights to specific deliverables are granted as described in your agreement. You may not copy, resell, or reverse engineer our systems without our written permission.
9. Disclaimers
The Site and our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, Home Wave Marketing will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Site or our services will not exceed the amount you paid us for the services in the three months before the claim arose.
11. Indemnification
You agree to indemnify and hold harmless Home Wave Marketing from claims, damages, and expenses arising out of the content or materials you provide, your use of our services, or your violation of these Terms.
12. Termination
We may suspend or end your access to the Site or services if you breach these Terms or your agreement. Sections that by their nature should survive termination will continue to apply.
13. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any disputes will be handled in the state or federal courts located in North Carolina.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site or our services after changes take effect means you accept the updated Terms.
